  • Contract of Employment with Emirates Leisure Retail LLC, of PO Box 122199, Dubai, United Arab Emirates (hereinafter referred to as the “Company”);
  • We are pleased to offer you employment with the Company in the United Arab Emirates (UAE) on the terms and conditions set out in this Contract of Employment as well as the Company’s Policy for conditions not provided for herein.
  • PART A – SPECIFIC TERMS OF EMPLOYMENT
  • 1. Position
  • You shall be employed by the Company in UAE in the position of:
  • Designation: AM Shift Leader 1
  • Business Unit: Costa
  • 2. Grade
  • Your position and role in the Company carry Grade 9 on the Company’s salary structure and employee grading system
  • 3. Start Date
  • For the purpose of continuation of your Benefits with this new contract, your employment is recognised and will be continuous from the (actual start date which is April 05, 2015) of your Original Contract of Employment.
  • The following Benefits will still be calculated on continuous service from your date of joining the company:
  • Annual Leave allowance
  • End of Service Benefits- Gratuity or Pension
  • Company Bonus / Incentive Scheme Eligibility
  • Annual Salary Review or Performance-related Merit Increases
  • 4. Place of Work
  • You shall be assigned to work in UAE. The Company has other workplaces in the member states of the Gulf Cooperation Council (GCC) and other parts of the world. You hereby agree that the Company considering its business needs, may require you to work in any of these countries and that the Company may relocate you in line with its relocation policy and procedure. Such assignments may be temporary or permanent.
  • 5. Term of Employment
  • The term of this Contract of Employment shall be a period of five (5) years commencing from the (31st of January 2023) - renewable, subject however to possible prior termination as provided in this Contract of Employment and provisions of the UAE laws.
  • 6. Salary
  • You shall be entitled to a monthly remuneration package which shall include your basic salary and any other allowances or contributions by the Company.
  • A) Basic Salary
  • During the term of your employment (as defined in Part B, Paragraph 3 of this Contract of Employment), you shall be paid the sum of AED 2300 (Two Thousand Three Hundred United Arab Emirates Dirhams only) each calendar month in arrears by way of basic salary.
  • B) Accommodation and Transport
  • Company accommodation and transport to your place of work will be provided throughout the entire duration of the contract. The value of the staff accommodation is set at AED1,100 (One Thousand, One Hundred United Arab Emirates Dirhams) and the value of your transportation is set at AED 300 (Three Hundred United Arab Emirates Dirhams) per month.
  • Please note that providing you with accommodation and transport is at the company’s discretion. Should the company ask you to move out of the staff accommodation you will be paid an accommodation allowance of AED1,100 (One Thousand, One Hundred United Arab Emirates Dirhams only) and a transportation allowance of AED 300 (Three Hundred United Arab Emirates Dirhams only) each calendar month in arrears.
  • 7. Home Destination
  • Your “Home Destination” shall mean the nearest international airport to your hometown: Mumbai, India.
  • 8. Leave Travel Allowance
  • Grade 9 employees are eligible for the equivalent value of 1 flight to their home country every 2 years.
  • The value of the flight will be paid in 2 instalments:
  • 1st payment: 50% of the flight value paid in first year of employment, after completing probation
  • 2nd payment: Remaining 50% of the flight value paid in the 2nd year of employment
  • Flights must be booked and paid for by the employee.
  • LTA is not accessible until after successfully completing 6 months’ probation

  • 9. Annual Leave
  • Further details about your annual leave entitlement are set out in Paragraph 7 of Part B of this Contract of Employment.
  • This offer of employment is valid for seven (7) calendar days from the above date. If the Company does not receive this offer duly signed by you, within the stipulated period this offer shall be considered null and void.

  • PART B - GENERAL TERMS AND CONDITIONS OF EMPLOYMENT
  • 1. Employer
  • You shall be employed by Emirates Leisure Retail LLC of, PO Box 122199, Dubai, United Arab Emirates a limited liability company incorporated in the Emirate of Dubai in accordance with UAE Federal Company’s Law pursuant to the terms and conditions of this Employment Contract and the Company’s Policy.
  • 2. Company Sponsorship
  • The Company shall apply to sponsor you for an employment visa in the United Arab Emirates. This Contract of Employment is subject to you being granted with a residence/ work permit by the UAE authorities and if you don’t fulfil these requirements to obtain a visa (e.g. due to a previous ban being imposed on you etc) this Contract of Employment shall be null and void without any liability or recourse against The Company. Your employment is dependent on the successful completion of the sponsorship application process, which includes satisfactory medical clearance. The Company reserves the right to rescind this Contract of Employment without any liability towards you should there be any problems with the medical and/or sponsorship application process.
  • You shall be required to provide the Company with the following documents to process the employment visa.
  • A) Employment Contract duly signed.
  • B) Copy of your passport with 6 months minimum validity and at least 2 pages empty
  • C) Copy of the relevant Professional Qualification certificate
  • D) Reference letters (when requested by the Company)
  • E) 10 coloured photos on a white background of size 3 cm x 4 cm & 1 digital copy.
  • 3. Term of Employment
  • Subject to satisfactory references being taken your employment with the Company shall commence on the Start Date and shall continue for the Term as specified in part A, or until terminated in accordance with the provisions of this Contract of Employment (the “Term of Employment”).
  • 4. Your Duties
  • 4.1 You may be required to undertake other duties, relative to your nature of work, from time to time as the Company may reasonably require.
  • 4.2 You warrant that you are entitled to work in the UAE, and you shall notify the Company immediately if you cease to be entitled to work in the UAE at any time during your employment with the Company.
  • 5. The Working Week and Hours of Work
  • 5.1 Your working hours shall be 48 hours per week exclusive of meal breaks and transport time from/to the Place of Work; as well as additional hours as required for the satisfactory performance of your duties. Your daily working hours shall be agreed with you in accordance with the practices of your Business Unit.
  • 6. Probationary Period
  • 6.1 The first six months of your employment with the Company shall be a probationary period (the “Probation Period”). During the Probation Period, the Company may terminate your employment at any time by giving you a 14-day notice in writing prior to the last day of your employment without payment of end-of-service benefits or any compensation.
  • 6.2 The employee must provide 1 months’ notice in writing if they plan to move to another employee during the probation period, and unless agreed otherwise, the new employer will compensate the first employer for recruitment and contract costs.
  • 7. Annual Leave
  • 7.1 Your entitlement to annual leave shall accrue on a monthly basis. If you have taken more leave than your accrued entitlement as of the last day of your employment, the Company shall be entitled to deduct the appropriate amount from any payments that are due to you.
  • 7.2 The scheduling of leave must be mutually agreed upon between you and your line manager. In cases where such an agreement cannot be reached, the decision of your department manager shall apply.
  • 7.3 You shall be entitled to apply for any accrued paid leave after 3 months of employment
  • 7.4 Annual leave entitlements are based on actual working days and the number of days allocated per employee will vary depending on the length of service within the company. This is illustrated in the table below:
  • 8. Double Benefits
  • It is the policy of the Company that if your spouse is employed by another company in the UAE, you should not receive dual compensation in respect of certain allowances, benefits, or expenses (such as medical insurance and School fees contribution).
  • In the event that your spouse is employed by or becomes an employee of any company in the UAE and your spouse is entitled to or is in receipt of, any of the allowances, benefits, or expenses that you are entitled to in this Contract of Employment or in any policy of the Company, the Company reserves the right to review and/or discontinue payment to you of all or any part of your benefits or expenses.
  • 9. Public Holidays and Time in Lieu
  • 9.1 You shall be entitled to all public holidays and all days declared by the Government of UAE as holidays for the private sector. Should you work on a public holiday, you shall be entitled to an alternative day off in lieu.
  • 10. Sick Leave
  • 10.1 Upon completion of the Probation Period, if you are prevented from attending work because of sickness or injury, you shall be entitled to receive your usual remuneration during each year of your employment:
  • (a) At full remuneration for a period of 15 calendar days; and
  • (b) At half of the full remuneration for a further period of 30 calendar days
  • (c) Unpaid leave for a period of 45 calendar days during each year of employment
  • 10.2 Unused sick leave entitlements may not be carried forward to another year of employment.
  • 10.3 All sick leaves must be processed in accordance with the Company’s sick leave procedures.
  • 11. Medical Expenses and Hospitalisation
  • 11.1 The Company shall provide you with the Company’s medical insurance.
  • 11.2 Medical and hospital treatment shall be provided for you in accordance with the Company’s Medical Policy.
  • 11.3 Chronic or pre-existing conditions must be disclosed to the Company prior to the Start Date and shall be assessed by the Company on a case-by-case basis.
  • 12. Bonus
  • You are eligible to participate in the Company’s Quarterly Sales Incentive Scheme which runs throughout the financial year from 01-April to 31-March.
  • The Scheme rules, including eligibility, set targets and payment criteria, are determined at the sole discretion of the Company, and may be amended, varied, or suspended from year to year as appropriate. These will be provided to you on joining.
  • 13. Non-Competition
  • 13.1 You hereby undertake and agree that upon expiry or termination of this Contract of Employment for whatever reason, you shall not work for, engage, directly or indirectly, or through any corporation or association in any business, enterprise, or employment which solicits business performs services or delivers goods that are competitive to those of the Company in the United Arab Emirates for two years from your last working date of your employment with the Company. You agree that this covenant is fair and reasonable; however, in the event that a court should decline to enforce these provisions, you agree that the provisions should be modified to restrict your competition with the Company to the maximum extent enforceable, but in no event with the covenants be interpreted as more restrictive to you.
  • 14. Confidentiality
  • 14.1 You shall not at any time or in any manner during or after the expiry or termination of your services with the Company, either directly or indirectly, divulge, disclose or communicate, other than for the benefit of the Company or for normal business practice, to any person, firm, corporation or other party in any manner whatsoever any information concerning any matters affecting or relating to the business of the Company. This includes but is not limited to any of its customers, agents, or otherwise the prices it obtains or has obtained for the sale of, or at which it sells or has sold, its products or any other information concerning the business of the Company, its manner of operation, its plans, processes, or other data without regard to whether all of the above-stated matters shall be deemed confidential, material or important, the Company and you specifically and expressly stipulated that as between them, such matters as important, material and confidential and gravely affect the effective and successful conduct of the business of the Company, and the Company’s goodwill, and any breach of the terms of this Article shall be a material breach of this Employment Contract.
  • 15. Release in the UAE
  • 15.1 You agree that upon request by the Company, and upon termination or expiry of your employment for whatever reason, you shall then return to the Company all documents, papers, or other materials in your possession or under your control, together with all documents, notes or your work products which are connected with or derived from your services to the Company and all copies obtained from the Company shall be either returned to the Company or as appropriate permanently destroyed.
  • 15.2 Upon termination or expiry of your employment with the Company, you agree to return to the Company any computer, hardware, mobile phones, or others that are in your possession and are used for the business of the Company.
  • 16. Termination and Notice Period
  • 16.1 Notwithstanding any other terms or conditions of this Contract of Employment, the Company shall be entitled to terminate your employment immediately and without notice if:
  • (a) You are in breach of Article 44 of the Labour Law;
  • (b) You are guilty of any gross misconduct or wilful neglect, or refusing to comply with any lawful and reasonable instructions given to you by any superior employee of the Company; or
  • (c) You commit or are guilty of any of the acts of omission described in Article 44 of the Labour Law.
  • 16.2 Should you wish to terminate your employment with the Company at any time after the Start Date, you must give thirty (30) calendar days’ notice in writing to the Company.
  • 16.3 After completion of the Probation Period, the Company may terminate your employment by providing you with thirty (30) calendar days’ notice in writing of such termination.
  • 16.4 The Company reserves the right to pay you your monthly salary to which you are entitled under the terms of this Contract in lieu of any notice period.
  • 17. Repatriation
  • 17.1 If this Contract of Employment is terminated for reasons, other than for reasons stated in Article 44 of the Labour Law or for you being in breach of the terms of this Contract of Employment, the Company shall provide you with a one-way economy class ticket from Dubai to your Home Destination.
  • 17.2 Upon termination of this Contract of Employment for any reason; you shall not be entitled to any repatriation benefit if you continue to work in the UAE.
  • 18. Consequences of Termination
  • 18.1 Upon termination of this Contract of Employment, the Company shall calculate and pay to you any outstanding amounts due to you until your last working day pursuant to the terms of this Contract of Employment and the Company’s Policy (“Final Settlement”)
  • 18.2 Your Final Settlement shall be subject to deduction of any outstanding amounts due to the Company.
  • 18.3 If you are being paid in lieu of notice in accordance with Paragraph 16.4 of this Contract of Employment, you shall be paid your salary, allowances, and any other benefits that are referred to in this Contract of Employment until the end of the notice period.
  • 18.4 On or before your last working day, you must return to the Company, your employee identification cards and all other documents and property which are in your possession, and which belong to the Company.
  • 18.5 Upon termination of this Contract of Employment and on or before your last working day with the Company and in compliance with the rules of UAE, the Company shall cancel your employment residence permit and your spouse’s and children’s residence permits (where applicable).
  • 19. End of Service Benefit
  • Once you have completed 12 calendar months of continued services with the Company from your Start Date you shall be entitled to an end-of-service gratuity in accordance with the provision of U.A.E. Labour Law at the time of leaving. Further details are available from the Company’s Policy.
  • 20. Company Policies and Procedures
  • Your Contract of Employment is subject to the policies, procedures, rules, and regulations of the Company, which may be amended from time to time at the Company’s sole discretion and without notice.
  • 21. Applicable Law
  • This Contract of Employment and your employment with the Company are governed by and shall be interpreted in accordance with the provisions of UAE Federal Law No. 33 of 2021, as amended (the “Labour Law”) and the other laws in force in the Emirate of Dubai.
  • 22. Conflict of Law
  • Should a conflict occur between this Contract of Employment and the provisions of the Labour Law, the provisions of the Labour Law shall prevail only to the extent that they are more favourable to you as an employee.
  • 23. Severability
  • If any provision of this Contract of Employment is or becomes invalid, illegal, or unenforceable in any respect under the applicable law referred to in Paragraph 21 above, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired in any way.
  • 24. Islamic Traditions and Country’s Laws
  • At all times, you must respect the Islamic religion and the laws of the UAE as well as its customs and traditions. In addition, you must always refrain from engaging in any activities which are detrimental to the security of the UAE.
  • 25. Information Security Management System
  • In line with Group Information Security Management System and all relevant policies. All employees of the organisation will receive appropriate awareness education and training and regular updates in organisational policies and procedures, as relevant to their job function.
  • 26. Entire Agreement
  • You acknowledge and agree that, in entering into this Contract of Employment, you are not relying on, nor have you been induced to enter into this Contract of Employment, by any statement, representation, warranty, or understanding (whether negligently or innocently made) of any person (whether a party to this Contract or not) other than as expressly set out in this Contract of Employment. The Company’s Policy is available on request via the HR Department. By signing this Contract of Employment, you acknowledge that is your responsibility to read, understand and abide by the terms of the Company’s Policy.
